Agreement Between The Panamanian Government, Company AES Changuinola, And Indigenous Ngobe Communities

An agreement of principles to ensure respect for the rights of indigenous peoples and strengthen national development signed on Thursday the national government, the Company AES Changuinola, SA and the Ngobe communities Charco La Pava, Valle del Rey, Chaguinola Up and Nance of Risco.

The Vice President and Foreign Minister, Juan Carlos Varela, noted that the entry of production of this plant will have a direct impact at the country level to lower energy costs for all Panamanians.

Varela Ngobe thanked the community for being part of the dialogue. "This firm is a very important step to advance the economic and social development of our country and assure you that this gesture will pay the benefit to all communities."

This agreement results from the High Level Commission set up by the National Government on 10 August, and chaired by Vice Chancellor and Varela, involving state, business and communities.

The signing of the agreement seeks to ratify the intention of the parties to reach understandings that lead to the solution of conflicts arising at the start of construction of the hydroelectric Chan 75.

In the ten-point document the parties agree that "the agreements to be reached eventually be based on respect for international commitments entered into by the State under the American Convention on Human Rights and other international instruments related to rights indigenous peoples ".

In the seventh article "communities recognize the importance and national interest involved in the development and timely project completion Chan 75, agree with it and understand that for some families it must be relocated.

The Representative Ngobe, Ernesto Lopez, asked the government to ensure that the agreement is enforced. "We believe we are doing something for the good of the communities and supporting the national government."

Signed by the National Government Juan Carlos Varela, Vice President and Minister of Foreign Affairs and Jorge Ricardo Fabrega, Vice Minister of Government and Justice and the AES Changuinola, James Tupper Bracho.

For indigenous communities Rafael Abrego, Celestino Abrego and Ernesto Lopez, Charco La Pava community, Santiago Santos and Ricardo Santos, by the Commonwealth of Changuinola Arriba; Wilfrido Abrego was born by the Community of Risco and Sunday Abrego and Agustin Jimenez for the King Valley community.

Panamá, 27 de noviembre de 2009.

Un acuerdo de principios para garantizar el respeto a los derechos de los pueblos indígenas y fortalecer el desarrollo nacional firmaron este jueves el Gobierno Nacional, la empresa AES Changuinola, S.A. y las comunidades Ngobe de Charco La Pava, Valle del Rey, Chaguinola Arriba y Nance de Risco.

El Vicepresidente y Ministro de Relaciones Exteriores, Juan Carlos Varela, destacó que la entrada de producción de esta planta tendrá un impacto directo a nivel del país al bajar el costo de la energía para todo el pueblo panameño.

Varela agradeció a la comunidad Ngobe por haber sido partes del diálogo. "Esta firma es un paso muy importante para avanzar en el desarrollo económico y social de nuestro país y les aseguramos que este gesto rendirá en beneficio para todas sus comunidades".

Este acuerdo es resultado de la Comisión de Alto Nivel instalada por el Gobierno Nacional, el 10 de agosto pasado, y presidida por el vicepresidente y Canciller Varela, con la participación del estado, la empresa y de las comunidades.

La firma del acuerdo busca ratificar la intención de las partes para alcanzar entendimientos que llevan a la solución de conflictos surgidos al inicio de la construcción de la hidroeléctrica Chan 75.

En el documento de diez puntos las partes coinciden en que "los acuerdos a los que eventualmente se llegue estarán basados en el respeto de los compromisos internacionalmente contraídos por el Estado conforme a la Convención Americana de Derechos Humanos y demás instrumentos internacionales relacionados con los derechos de los pueblos indígenas".

En el artículo séptimo "las comunidades reconocen la importancia y el interés nacional envuelto en el desarrollo y culminación oportuna del proyecto Chan 75, están de acuerdo con el mismo y comprenden que para ello algunas familias deben ser reubicadas".

El Representante Ngobe, Ernesto López, solicitó al gobierno que vele para que el acuerdo se cumpla. "Nosotros consideramos que estamos haciendo algo por el bien de las comunidades y en apoyo al Gobierno Nacional".

Firmaron por el Gobierno Nacional Juan Carlos Varela, Vicepresidente y Ministro de Relaciones Exteriores y Jorge Ricardo Fábrega, viceministro de Gobierno y Justicia y por la AES Changuinola, Jaime Tupper Bracho.

Por las comunidades indígenas Rafael Ábrego, Celestino Ábrego y Ernesto López, por la comunidad Charco La Pava; Santiago Santos y Ricardo Santo, por la Comunidad de Changuinola Arriba; Wilfrido Ábrego por la Comunidad de Nace de Risco y Domingo Ábrego y agustín Jiménez por la comunidad de Valle del Rey.
